Will he pay child support if unemployed and living off a settlement?

My daughters father was injured in an accident and received a structured settlement. We have been together for 10 years, our daughter is 4. The accident was 2 years ago and we have been engaged for 2 years. If we separated, would he have you pay child support if he isn't working and living off of his settlement?

Answer: The issue is his income, not its source. We would examine his “line 150” of his income tax return. This would be deemed his income for child support purposes. We would use this number, in relation to the Child Support Guidelines, to determine the child support that he would be required to pay.
