You can file for Divorce in BC and the filed divorce papers will need to be served on your ex in Alberta. We separated in 2004 August, had a financial/separation agreement Court Order in 2009, which she broke by taking almost all the investments that she could (spousal RRSPs) and is unrepentant and will not give them back. I am confident that she has spent or concealed them and I would just like to get the divorce irrespective of the money. She expressed a willingness in the past to proceed and our children are over 18. She lives in NB and I live in BC. What steps should I take?
Hi Alan, You will need a long-form marriage certificate and a copy of your separation agreement. Then you can file for divorce in either BC or NB, provided you and your ex have been living in those provinces for the last year.
