We are in the process of dividing our assets.

Anonymous Asked:

We are in the process of dividing our assets. I recently received my ex's financial statement and on it she put an account that wasn't brought into the marriage. The account was an investment account that had approx 200K in it and was worth almost nothing when we separated. Is she allowed to show this account? She didn't manage the account her father did.

You are both entitled to declare pre-marital assets and debts in order to have them taken into consideration when comparing your respective net worth on the date of separation. In short, she is entitled to seek a “deduction” of the approximate $200,000.00. The issue is whether a Judge would provide this deduction to her based on the facts of your case, especially if you are not aware of this account and it has now been dissipated to zero. This is an important issue for you, given the substantial amount involved, and thus I recommend that you telephone me at 877-668-9386 for a free consultation. Once you have provided me with full details surrounding this account I will provide you with guidance.
