Can you file for divorce in another province than where you live?

My dad age 79 married his wife 20 years of junior about 13 years ago in China. Approx. 8 years ago they moved to Toronto from Taiwan and just recently(1.5 years ago) dad decided/pushed to sell his house in Taiwan. He moved all cash available from the sales of house in Taiwan to Toronto. Unfortunately, due to his old age and lack of proficiency in English, his wife managed all of their financial transactions. She used a good portion of the cash to buy a house under their names and her adult daughter's name from previous marriage. The remaining cash was transferred out of joint accounts and into her own personal accounts. Now that dad is left with nothing and she creates an uncomfortable living situations for him by renting out all of available rooms in the same house and ignore the existence of my dad. They both want a divorce but his wife won't claims everything is hers. Now dad wants to move to Calgary with me and can he file for a divorce in Calgary and claim what is rightfully his? If so, how would I help him to proceed. Thanks in advance............

Answer: No, your father cannot make a divorce claim in Alberta. This is because the Divorce Act states that a person, or the opposing spouse, must live in the province where the Divorce Application is commenced for a minimum of one year prior to the commencement of the Divorce Application. Thus, the Divorce Application must be commenced in Ontario. However, once it is commenced in Ontario, then AFTER IT IS FIRST COMMENCED IN ONTARIO your father can then move to Alberta – and the Divorce Application will still be allowed to continue in Ontario.

In terms of property, both spouses are entitled to an “equalization of net family property” under the Family Law Act. All assets and debts of both persons are taken into account as of the date of marriage and date of separation, and then equalized. That amount can then be adjusted up or down based on certain fairness criterion, based on s. 5(6) of that statute. So, regardless of whether your father’s wife has placed assets in her name with your father’s money, we can absolutely ensure that your father is treated fairly and gets what he is entitled to receive.
