Do I get my ex-common law partners work pension?

Anonymous Asked:

I was common law with a man until 10 years ago. I am living common law with a new partner now but there was no legal seperation from the first man. We remained very close till the day he died. Now that he is gone his work has contacted me about his pension. I have been honest with the company and they want to give me his penion. do I have a right to it or am I going to run into trouble down the road?

A Family Lawyer

I am not able to give legal advice here. I am not sure if you are referring to a CPP pension or employment pension. The fact of a subsequent relationship does not impact your entitlement. You need to consult with a family law lawyer. You may be entitled to pension and survivor benefits and some pension plans recognize common-law spouses when it comes to paying out death benefits. Generally, you need to apply to the administrator of a pension plan to receive the benefits. It is quite possible that you are entitled to certain benefits. However, there are forms to complete for the pension administrator, and those forms should be completed accurately.
