The issue is survivor benefit entitlement under the pension plan. The best course of action would be to discuss the issue with a family law lawyer or a pension actuary who is in a position to review the terms of the pension plan and give an opinion as to whether the survivor benefit portion of the pension plan is in effect. You would need to provide that lawyer or actuary with details as to the pension member's date of retirement and date of your separation from that pension member. In respect of the pension monies from Canada Pension Plan, you should contact Service Canada because there are many rules changes over the years.
