What If I can't financially stay in the house ?

Hello, my husband has been mentally cruel and at times physically.I would like to know whether monies from contributing to a pension plan from an ex employer has to be divided? rrsp's?( all accounts are in my name( sole account). we both have separate accounts since the beginning of our relationship, only the house is in both names( paid off).If I can't financially stay in the house , is it ok to move out?

If you are currently residing in Quebec with your husband then family patrimony rules will apply and you will have to split the value of the family residence and pension plan. Bank accounts are usually also split but that will depend on your matrimonial regime.

If your husband is treating you badly then you should leave the house or have him leave the house. The law does provide for some financial relief in these circumstances. I would recommend you consult a lawyer to review your options.
