move back to my country of origin with our child

Hi I would like to get a divorce and also move back to my country of origin with our child. I do not wish any of our possessions or money, just full custody of the child so I can move on with my life and complete the divorce from distance. Please advise me on the best option to do this in accordance with the Canadian law.

Divorce proceedings will not hinder you from relocating to your country of origin. It is possible to obtain a divorce even if you are living elsewhere.

What is a hindrance however is that you cannot relocate your child without your ex-spouse's permission (get written, notarized permission) or permission from the Court. To do so can have serious consequences including criminal charges for kidnapping.
