Where can I file divorce papers in the GTA?

Anonymous Asked:

I have been separated from my husband for more than a year, and we have signed uncontested divorce papers. I've been to 2 different court houses and both said the divorce papers are not dealt with there.

Where can I file these papers? (Anywhere in the GTA/Brampton or Mississauga is fine)

Also, can I file both the application for a divorce and divorce papers at the same time?

Thank you so much!

Answer: 1. You have mentioned an uncontested divorce and divorce papers. I really need to speak with you to clarify. I will, however, provide the following general comments:

Divorce: only the Ontario Superior Court of Justice deals with divorces. I assume that you have been turned away from the Ontario Court of Justice, which has no power to deal with divorces. If you live in the Region of Peel, then there is a Superior Court of Justice in Brampton.

Divorce Papers: as stated, I need to speak with you to obtain more information. However, if you are asking where to register a Separation Agreement to enforce support, then the above answer is reversed. You go to the Ontario Court of Justice.

I STRONGLY recommend that you call me for a free consultation, at (877) 668-9386, so that I can ask a few questions to ensure that your questions are fully answered.

(The information provided above is general, not legal advice, as circumstances vary from case to case. Thus, if you wish legal advice that you can rely upon for your specific case, please contact Douglas Briand for a free consultation).
