Child support for pregnant stay at home mom

Anonymous Asked:

I have been married for 26 years and have three children and twins on the way. Although I worked full time for more than half our marriage I started working part time once we had our second child with special needs. I am currently not working as I had a threatened miscarriage during my first trimester. As well the number of hours I worked part time for the past couple of years have been limited so that I could be at home with our kids. What are the most important first steps to ensure child support for pregnant stay at home mom? My husband and I are currently living separately. I am in the home but do not have the financial means to pay the bills of a large home, groceries, child expenses etc.

Given your factual circumstances, it is imperative that you obtain financial security by either having a separation agreement finalized, or obtaining a Court Order. Child support is mandatory under the Child Support Guidelines. Spousal support is not mandatory, however based on your factual circumstances if the father earns enough money you will almost certainly receive spousal support. Prior to being able to comment further I would need to gain information with respect to the father’s income. Once there is either a signed separation agreement or Court Order then the child support, and spousal support if applicable, would be garnished automatically through the Family Responsibility Office. This would provide you with guaranteed support payments on a monthly basis, rather than having to worry about whether he will actually provide any funds to you each month. If you wish to gain further details you are welcome to call me at 877-668-9386 for a free consultation.
