Can she try and collect alimony if I'm outside of Canada?

Anonymous Asked:

Please help. I was married for 10 years and my wife never worked because she never felt the need to since I was providing, we had no children and she collects half my salary. I can not afford to pay my rent or my car anymore which I need to get to work to make money to pay her. I recently got a job outside of Canada in Latin America. will I still have to pay her alimony? It's been close to 2 years she is collecting and hasn't looked for a job. I'd rather live abroad knowing I can afford to live a normal life. Can she try and collect alimony if I'm outside of Canada, thousands of kilometers away and paying taxes in a foreign country with no ties in Canada? Please, any assistance would be greatly appreciated

Yes, your ex-spouse will be able to request and obtain spousal support from you even if you live in another country. Execution of a Canadian judgment could be an issue for her if you live abroad but many countries currently have treaties making execution and collection of support relatively easy.

However, the Divorce act does specify that each spouse must try to reach financial autonomy. If there is no hindrance to her obtaining employment and if she is not making any efforts to reach financial autonomy then it could be possible for you to have your Spousal support obligation cancelled or at least reduced.
