Can I claim for a bigger amount of alimony?

Anonymous Asked:

Can I claim for a bigger amount of Alimony because a new partner of my ex is earning a huge salary and I can't find a job because I had no chance other than to move from Ontario to Quebec where my son lives and I don't speak French?

Spousal support is evaluated following analysis of several factors which differ from case to case. In certain cases one particular factor might be deemed very important for evaluation purposes and in another case the same factor could be deemed to have little or no importance.

Language is certainly a factor but it isn't necessarily a crucial one. As for your ex-spouse's new partner, his or her income doesn't factor in as revenue. It isn't your ex-spouse's revenue. However, it can have an impact on your ex-spouses' expenses if you can prove that his financial needs have diminished due to the new relationship and that he now has more available income at his disposal. If your financial needs were not met before due to limitations in his income then you could petition the court to have your support revised because of your ex-spouse's new relationship.
