My ex husband put in a stop order to FRO (family responsibility Ontario) 3 yrs ago before my daughter was 18. He lives in Ontario I live in Quebec. our divorce and child support order is here in Quebec. This month the Fro decided to put that order into effect and my child support payments are being held by FRO. I called my worker who says he has to call them to get the money released.. Of course he is refusing to take my phone calls. I need to know what my rights are and how can FRO do this when the court order is here in Quebec. My daughter is 20 but she is going to School in another province and is totally dependent on me until the end of this year (she is an honor roll student and is unable to work during school because the course is very intense and most of it is stage). I cannot support her on my own without the help of the child support. I thought that only a Judge could stop child support? do I have any rights here and if so how do I go about to get the money released.

If the judgment granting support was made in Quebec (and if the child was in Quebec at the time), it implies that Revenue Quebec is seized of the execution of the order in Quebec. It also implies that the rules governing the payment of support are also governed by Quebec law. The Ontario Family responsibility office should then only be an intermediary for Revenue Quebec and not making decisions on their own. Contrary to rules in Ontario, in Quebec the payer cannot stop or suspend support without a court order. Action can then definitely be taken to force the Family responsibility office to respect the Quebec judgment. Since FRO has been collecting child support for Revenue Quebec, you should advise your Revenue Quebec representative of the situation and they should be able to rectify the situation with the Ontario Family Responsibility Office.
