Hi. I've finally made the step to have my husband move out of our home. I've gone through years old emotional and physical abuse because of his addiction to alcohol. He recently cheated on me...yet again. I'm just wondering how long I need to be separated for a divorce....

You and your husband may have been living separate and apart but under the same roof. It is best to consult with a lawyer as to the date of separation, as it is not necessarily the date on which he moved out of the home. Once you have determined the date of separation, you would make application for a divorce one year after the separation. The ground you would be relying on in respect of your divorce claim is having lived separate and apart for no less than one year.
