How to get a marriage certificate?

Anonymous Asked:

I was married in a different country. I was at the time and still am a Canadian citizen (as is my ex). I want to apply for a divorce but do not have a copy of my marriage certificate. How do I go about getting a copy or getting divorced without a copy of it?

The state or government office in the Country in which you were married may issue a replacement copy of the original marriage certificate. For example, Service Ontario performs that function for marriage certificates issued in respect of marriages in Ontario. There is important information on the certificate necessary to obtain a divorce. Presumably, you need the marriage certificate, or a replacement of it, to have that marriage legally and formally recognized in Ontario and then proceed with the divorce application. As such, there must be some evidence of the formal and ceremonial requirements being met in order to prove the validity of the marriage in the foreign country. If the certificate cannot be located, then you should consult with a lawyer to determine if there is any legislation that may apply, for example, in Ontario there is a Marriages Act.
