The Canadian divorce act requires one year residency in a particular province in order to be able to file for divorce in that province. You would therefore not be able to file for divorce in Québec if you are not a resident of that province. However, if you fulfill the one year residency requirement in another province you will be able to file your divorce in that province and this even though your ex-spouse lives in Québec.
