Deciding to Separate

I have decided to file for divorce from my husband. It has been years of emotional, mental and verbal abuse. We had a fight on Friday and I left to stay with my parents for the weekend. I have not told him about wanting a divorce yet just that I needed space. A friend says I should not go back as I have "left the matrimonail home". Since this process has not happened and I plan on returning, will it effect any of the legal matters in the future.

You are not considered to be "separate and a part" until one party advises the other the marriage is over. You can leave the home for a brief period. I would not recommend that you leave the home on a permanent basis until you have settled the financial aspects of your case. I suggest that you contact a lawyer in your area for assistance.
