My son moved in with me, should I receive higher child support ?

Our child support payments are based on Shared Custody of 2 children. However, my 16 year old son has decided to move in with me permanently, not wanting to be at his dads. Can I now receive higher child support payments for him? My daughter continues as the original agreement was written.

The Agreement would need to be changed, which you can do on your own using the assistance of the child support calculator on divorce-canada.ca website or seek the assistance of family law legal counsel. The steps would be to exchange income information, do the calculations (one child shared and another child primary residence), prepare a written amending agreement, and implement the new support amount by registering with the Family Responsiiblity Office, if so registered, or replacing any post-dated cheques that may have been passed on the basis of the original agreement. In addition to the basic Table amount, the original agreement may have provisions in relation to section 7 expenses, and the responsible proportions of such expenses would need to be addressed if there is any change in income information since the original agreement. Also, the amount of life insurance in place in order to ensure that the child support obligations are properly secured would be reviewed and adjusted if necessary, as the one parent will be paying a high amount of child support.
