The question as I understand it is whether you should be concerned about time frames or limitations on making a claim after separation, for division of property etc.
> The Ontario Limitations Act does provide a general limitation period which is 6 years after a separation or 2 years after a divorce, whichever is EARLIER to bring a court claim for property. So, if you have property claims and you are separated from your spouse, you should, in order to avoid limitation issues, make a claim for property division within 2 years just to be safe. After 6 years from separation, you will be barred from bringing any claim or having any entitlement to share in the matrimonial assets. If you are claiming spousal support, you have TWO Years only to bring a court claim from date of separation. It is always better to try to resolve these matters earlier rather than later to avoid a potential limitations period issue.
