Do I need a paralegal or a lawyer?

Anonymous Asked:

I've been reading a lot about family lawyers and I'm wondering if I even need one. My ex and I agree on everything so why do we each need to hire a lawyer. Can't we just bring our case to a paralegal and have them draft up the separation agreement and pay a lot less? The one thing that isn't clear is if a paralegal can submit our separation agreement for us or does it have to be reviewed from a lawyer? Also, after one year of living separate, can we use the same paralegal to file our uncontested divorce? Do I need a paralegal or a lawyer?

In Ontario, paralegals are not qualified to assist with family law matters; only lawyers are. You may choose to proceed without the assistance of a lawyer, however I strongly urge you to consult with a lawyer before signing a separation agreement or proceeding with the uncontested divorce.
Property and support issues can be very complex and it is good to have a proper understanding of your rights before signing anything! If you do sign and you chose not to get a lawyer, EVEN IF the agreement you reached is unfair, it will likely be very difficult to change it. Many people do not understand what they are actually entitled to in law, and it is worth it to understand your legal rights before signing anything.
