If my boyfriend and I move in together, will both incomes be considered in child support payments when he finalizes his divorce and child custody/support of his children from his previous marriage?

A: No only the payor’s income is relevant to determine child support obligations. A new partner’s income plays no role in determining child support. A new partner’s income can play a very minor role in the issue of determining spousal support – where the need for and ability to pay spousal support can be affected by a partners income ( solely by reducing or offsetting the household family expenses being claimed by either party) such that their claimed amounts must reflect the reality of any house sharing responsibilities which ought to be apportioned between a couple living together, in proportion to their respective incomes.
