When does child support end?

Anonymous Asked:

My divorce agreement was finalised at the end of 2009 when, of our four children, two were still minor and in the custody of their mother. Both those younger children are now over 18 and I see no clause in the agreement that discusses when it will terminate. All costs have been paid up until now, so the issue is not the past but the future. What does family law say about this? When does child support end?

The exact wording of your agreement is important in this case but notwithstanding your agreement here is what happens to child support once a child reaches 18 years of age:

Support at 18 years of age becomes conditional on the child pursuing higher education or being incapable of providing for him or herself.

The amount payable is therefore reevaluated to consider the child's actual means (revenues) and needs (expenses).

In Quebec a court order will be needed to have child support reevaluated as the change is not automatic and agreements or judgments without provisions to the contrary effect remain in effect even after the child reaches 18 years of age.
