What are might rights during separation in relation to our home

Anonymous Asked:

My wife and I are currently separated and while she is working I have been paying all the bills. Tension is increasing in the home because I refuse to let her bait me into an argument. She has started trying in other avenues. The cable and internet were in her name even though I have also paid the bill so she changed the password on the wifi so I couldn't have internet and took all the cable boxes and changed them out and removed from my room. She then brought her cousin over to stay for who knows how long without my consent. He is an adult with a not so good past that I don't appreciate having around our child. Do I have any recourse or do I just have to deal with this? I don't want to do anything that could get me in trouble with the court during the divorce.

Answer: If the living situation is intolerable, then we can seek a Court Order for “exclusive possession of the matrimonial home,” which means that she and her cousin would be compelled to move out. In terms of you taking other steps in response, without a Court Order, you need to be reasonable and cautious. We can discuss your exact wishes, if you wish, during a free consultation.
