What does separation involve compared to divorce?

Divorce means you are no longer married and can legally remarry. Separation means you and your spouse are no longer living together (and that you no longer intend to be a couple). Typically a Separation is formalized by way of a written Separation Agreement (setting out all agreed upon terms regarding your respective obligations and entitlements and waivers and releases of a wide variety of potential future claims). Negotiating a Separation Agreement does not need to involve the court system whatsoever. Whereas a Divorce requires a party to file claims in court and serve the other party who must reply if they oppose the relief sought.
