Non-harassment clauses are not uncommon in separation agreements, however quite atypical in marriage contracts or cohabitation agreements. The conduct between spouses in itself is not relevant to the determination of support issues, however any consequences flowing from that conduct may be taken into consideration. Also, if there is misconduct between spouses and there are children involved, those circumstances may also require some inquiries into the exchanges between the spouses. The clause as to being serious in the relationship is not enforceable any more than a clause requiring the relationship or marriage to be of certain length or number of years.
