Is my divorce in the middle East valid in Canada?

Anonymous Asked:

Hi,
I got married in a middle Est country and also got divorced in that country. Me and my ex-husband have Canadian citizenship but he does not live in Canada anymore. Is the divorce I got from him also valid in Canada please? In the country I got married, the law for divorce is "separation des bien" by default. Is this will be also applicable here in Canada, if I want to legalize also my divorce here please?
Thank you in advance and Regards

If you were married abroad and your divorce has already been pronounced abroad you do not need to legalize it here. You are divorced no matter where you live.

That said, if ever there are outstanding claims in Canada relating to your divorce then it will become necessary to have your divorce recognized by a Canadian court in order to either prove your claim to property here or defend yourself against such a claim.

If this is the case and you and your spouse were domiciled in Quebec at time of separation, rules governing the family patrimony would most likely apply to your case.
