Depending on your financial situation, you may qualify for legal aid. You will need to contact Legal Aid to determine whether you qualify. There is also a Family Law Information Centre (FLIC) located at the Newmarket Courthouse, where you can obtain information and assistance with respect to preparing your Divorce Application.
You do not need your husband’s signature to commence the application for divorce, however you will need to serve him with your materials. If you do not know how to find your husband after using your best efforts to find him, you will need to bring a motion asking the court for an order for substituted service, or alternatively an order dispensing with service on him. You will have to provide evidence showing you have made reasonable efforts to locate your husband which have been unsuccessful, and either substituted service on another individual (ie. a family member known to have contact with him) would bring the materials to his attention, or alternatively, that no method of substituted service would be effective. I strongly recommend that you consult a lawyer to discuss your situation in greater detail.
