My ex husband did not pay me the full amount as agreed on our separation agreement, and 8 years later still owes me $13,000, is the separation agreement still binding and can I pursue this amount thru the courts?

A: If there has never been a Divorce granted nor any order for Division of Assets under the Family Law Act or its predecessor Family Relations Act, then you ought to be able to bring an action under the FLA seeking a division of assets or to enforce your agreement. Otherwise there is generally a 2 year limitation from the date he was supposed to have paid or a 6 year limitation for suing on a debt in BC.
