I just immigrated to Canada. Can I file a divorce?

Hi I just came here 2 months ago and still finding a permanent job. Can I already file for divorce? They said I should have tax record first before I can file. I was separated for almost 10 years now.

You are required to ordinarily reside in the country for no less than one year before the commencement of the divorce proceedings. That means a simply divorce application. Otherwise, if the other spouse has resided in the country for at least one year then you may proceed with the divorce application on the basis of the other spouse's residence. If you commence a divorce application which includes other claims, such as, support and property, then the party simply needs to be resident that jurisdiction at the time that the proceedings are commenced.
