There is provision in the Divorce Act that a divorce application be stayed if reasonable arrangements for the support of the children have not been made. You may file for divorce and not pay child support, however your divorce will not be granted. If you want a divorce and are not paying child support then you need to explain why there are no support payments being made. If there is not a reasonable explanation for the lack of child support payments, then you will not be granted the divorce order. Child support is a pre-existing right of the child and should be paid whether there is an agreement or order requiring payments or not.
