If you were living common-law for 11 years, are you required to sign divorce papers after a split?

The father made the statement that he is not interested in having any relationship with kids and he is not helping in anyway either.  He had been missing for almost a year. Does this mean I have full custody?

Can we prepare our own separation agreement and take it to a lawyer during our consultation to review and add comment – basically if we do all the paperwork and the lawyer just reviews it for content and accuracy and then notarizes and registers it.
