How do we file for an uncontested divorce?

Anonymous Asked:

Hello, I am a Canadian citizen by birth and in Oct 2012 I married an American. She has not been living with me in Canada, but has come to visit me. Since our marriage we have only been physically together about 8-10 months total. Last year we applied for her permanent residency papers (which is still pending but will be withdrawn in about a month). I have recently realized that it will not work and that our marriage has broken down. She has agreed to my request for a divorce and wants no alimony. How do we file for an uncontested divorce?

In order to obtain your divorce from your wife you can file for your divorce in Canada based on your residency here for over 1 year. If both parties agree, you can file a joint divorce proceeding which both of you will sign and file together. This is the easiest and more cost effective manner to obtain your divorce if the parties agree on all of the accessory measures, i.e. separation of assets, custody of children, support payments, etc.
