My spouse and I got legally married in Canada. It has been less than a year. I reside in Canada but my spouse does not and at no time did we ever live together. Now we want to completely divorce and continue our lives without each other.

Do we still need to be married/separated for a year before filing for divorce? Would our assets be divided equally? I have since gotten a new job with a higher salary but that's the only change on both ends.

Answer: We can file the divorce now. You do not need to wait. The issue is when it can be finalized. That depends on which ground you use for the divorce. In terms of property division, section 5(6) of the Family Law Act allows an unequal division based on certain factors, including for short term marriages, which are defined as 5 years or less.
