Divorcing an illegal immigrant

Posted in Anonymous Q & A, Divorce by Questions on January 12, 2013

I was married when I was 18 (yes I was young naive and in love) I later found out he only wanted to marry for sponsorship. I did not sponsor him and we separated a year later. I’m now engaged and wanting to get married, but need to get divorced first. He’s now living in Canada illegally and is scared that by doing the divorce he will be deported. I haven’t seen him in five years, but can contact him. We both want this divorce so no one would be suing anyone. What are my choices so he doesn’t get deported?

I need more information to properly answer your question, for example:

-what is the date of your marriage?
    -where were you married?
-when did he arrive in Canada?
    -did you consummate the marriage?
-did you sign a Sponsorship application for immigration purposes?
-if so, how long does the sponsorship last?
    -where is he living now?

These are a few details that come to mind.
