What happens when my ex goes onto maternity leave?

Posted in Cambridge, Children, Location, Ontario by Questions on June 8, 2015

For a shared custody agreement, what happens when my ex-wife goes onto maternity leave for having a baby with her new husband. How will this affect my child support payments for our one child together. Do I make up the difference from her decreased income or do I continue to pay what I pay now?

You have asked a very technical legal question. We can most certainly provide you with an answer; however we first need to know whether there is a signed Separation Agreement or Court Order with respect to child support. If so, we need to read it prior to providing you with any guidance. You are welcome to telephone me at 866-557-3222 for a free consultation and, if there is either a Separation Agreement or Court Order in existence, you may then e-mail it to me and I will read it before we speak, as part of the free consultation.

(The information provided above is general, not legal advice, as circumstances vary from case to case. As well, generally speaking, the above information relates to Ontario law. Thus, if you wish legal advice that you can rely upon for your specific case, or if you are making inquiries where Ontario law may not apply, please contact Andrew Kania for a free consultation).
